In these Terms, references to 'member' shall mean the end user accessing the website/platform and its contents. The term 'member' also includes individuals such as father, mother, brother, sister, relative, or friend ('Registrant/Proposer') of the prospective bride/bridegroom. The terms 'You' and 'User' shall be used interchangeably to refer to 'the member'.
1. Eligibility
a. To register as a Member of this website, you must be legally competent and of legal marriageable age as per the laws of India (currently, 18 years or older for females and 21 years or older for males).
b. This website is intended solely to facilitate personal advertisements for lawful marriage alliances between individuals belonging to the Sindhi Hindu community, who are legally competent to marry under their respective laws. Membership in the Service is void where prohibited by applicable law.
c. By using this website, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; submit relevant information to us; and that you are not prohibited or prevented by any applicable law, current court order, decree, or injunction from any court, tribunal, or competent authority that restricts you from entering into matrimony.
2. Account Security
You are responsible for maintaining the confidentiality of your login credentials you designate during the registration process, and you are solely responsible for all activities that occur under your account.
3. Term and Termination
a. This Agreement will be effective, valid and subsisting as long as you use our website.
b. You may terminate your membership at any time, for any reason, by deleting your profile from the website.
c. The developer / service provider of the website may terminate your access to it and/or your membership for any reason including but not limited to the breach of the terms of use, using the service for commercial purposes, engaging in prohibited or inappropriate communication or activity. Further, the service provider may terminate your access and deactivate your profile without any notice and without assigning any reasons.
d. Certain provisions of this Agreement including sections 3 to 10 shall remain effective even on termination. Also, termination of your access to this platform shall not relieve you of any obligations arising or accruing prior to such termination.
4. Non-Commercial Use by Members
The website is for the personal use of individual members belonging to Sindhi Hindu community to advertise and promote their profiles for the purpose of generating relevant matches and cannot be used in connection with any commercial endeavours. This includes providing links to other websites. Illegal and/or unauthorized uses of the website, including unauthorized framing of or linking to the website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
5. Other Terms of Use for Members
a. No information provided by a candidate or by their proposers on this platform has been verified by us. You are requested to verify the credentials of the prospect, exercise due care and caution regarding their profile information which includes marital status, educational qualifications, financial status, occupation, character, health status, etc. and satisfy yourself before making a choice of your match. The service provider shall not be liable for short coming due to any misrepresentations made by any of the members.
b. Multiple profiles of the same person are not allowed on our website.
c. If a member gets married or is not interested in marriage for the time being, it is the responsibility of theirs or of their proposers to immediately delete the profile or intimate the service provider over email for deactivation of their profile. If profile of such a member continue to be active, the service provider would deactivate it on learning about the same from some other member or otherwise. Also, a profile, which have remained inactive for six months, will be deactivated. It should be clearly understood that deleting any user profile, without assigning any reason, is a prerogative of the service provider.
d. You confirm that the Content, information including the personal information provided by you is correct and accurate. If you are creating the profile on behalf of your friend/sibling/children, you hereby agree that you have the required permission/consent from the particular person whose profile is created on this platform by you. Impersonation is a crime and punishable under various laws.
e. You confirm and undertake at all times to keep the information up to date.
f. You are prohibited to give contact details in any form - Email, Phone nos., Messenger Ids, Postal address etc. in any fields other than the specific ones where the same information is asked. If any member who puts the above information in any field other than the one meant for that purpose then the service provider may deactivate such profiles.
g. The service provider shall not be held responsible for any interactions/ passing of information(s) etc. between any User via email, chat or any other medium with another User and the service provider has no obligation, to monitor any such disputes arising between the Users, and the service provider shall not be party to such dispute/litigation etc.
6. Content Posted on the Platform
a. With respect to the content you submit or make available for inclusion on the website, including but not limited to your contact details, you hereby unconditionally and irrevocably grant to the service provider the consent and license to use, store, distribute, reproduce, prepare derivative works of, modify, adapt, publicly perform, and publicly display such content on the website and to the members of the service provider's community website(s) from time to time.
b. You must use the service provided through this platform in a manner consistent with any and all applicable local, state, and federal laws, rules, and regulations.
7. Disclaimers
a. The service provider is not responsible for any incorrect or inaccurate Content/listing posted on the website or in connection with the developer’s service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized in the Service, nor for the conduct of any User and/or Member of the service provider whether online or offline.
b. The service provider assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User and/or Member communications or any communications by the service provider to its Members.
c. Under no circumstances will the service provider be responsible for any loss or damage resulting from anyone's use of the website or the Service and/or any Content posted on the website or transmitted to the Members.
d. The service provider expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any Content/listing posted on the website / made available to the service provider by any Members or the users of the website or any third party.
e. The service provider does not assume any responsibility or liability for any illegal Content posted on the website by any Members, users or any third party.
f. The service provider assumes no responsibility for any damage or loss arising out of any cybercrime attempted or committed by anyone.
g. All liability, whether civil or criminal arising out of any Content that is Posted on the website will be of that Member / user / third party who has posted such Content and the service provider reserves its right to claim damages from such Member/ user / third party that it may suffer as a result of such Content Posted on the website. The service provider does not claim ownership of Content you submit or make available on the website.
8. No Liability
The objective of the service provider is to serve, free of cost, a social cause by bringing in contact a prospective bride / groom and / or their profile creators. Since this is a social service without any profit motive, the service provider will not be responsible for any financial, reputational or any other damages suffered by the users. The question of any claim against the service provider therefore doesn't arise and in no event will the service provider be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the website.
9. Jurisdiction
If there is any dispute about or involving the website and/or service provided by using the same, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Mumbai, India only.
10. Indemnity
You agree to indemnify and hold the service provider, its officers, agents, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part. This indemnification obligation will survive in perpetuity.
11. Confidentiality
Any feedback you send to the service provider shall be deemed to be non-confidential. The service provider shall be free to use such feedback/information on an unrestricted basis. Further, by submitting the feedback, you agree and confirm that (i) your feedback does not contain confidential or proprietary information of yourself or third parties; (ii) the service provider is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) you are not entitled to any compensation or reimbursement of any kind from the service provider for the feedback under any circumstances
12. Other
a. This Agreement, accepted upon use of the website and further affirmed by becoming a Member, contains the entire agreement between you and the service provider regarding the use of the website and/or the services of the website. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
b. By becoming a member of this website and/or using the services of the website, you unconditionally and irrevocably confirm that you have read and understood the above provisions and agree to abide by them. If you are not agreeing to any of the above terms and conditions please refrain yourself from registering on the website.
c. The service provider may changes / modify the Terms of Use / Service Agreement and the users are expected to see the changes on this website. The users should continue to make use of this website only if the changes / modifications are acceptable to them.
d. This Agreement is an electronic document in terms of the Information Technology Act, 2000 and Rules there under pertaining to electronic records.
